According to the constitution, the punishment for traitors is execution

But treason is carefully defined as something that only applies to giving aid to enemies of the US during a time of war. The US hasn't declared war since WWII.

Yea well. The alien Enemies Act was supposed to only apply to wartime as well, but see how that turned out.
