Personal note:

This is a dangerous precedent that is already being used to justify banning trans women from women's bathrooms, and will likely allow male police / security to manhandle women to ascertain their gender. It will also put trans women at a further disadvantage for getting jobs, as if there wasn't enough stigma as is.

Get ready for the genital inspectors, more transpotting (like with that non-trans lady in the Olympics) and an increased amount of abuse of trans people.

Before someone comes in here and says "trans women are making women uncomfortable in bathrooms":

  • Trans women have been using women's bathrooms for decades, and people didn't care or notice until now.
  • If you force trans people to use bathrooms that match their birth gender, you advocate for putting hairy trans men with bald spots in with women in their bathrooms, I'm sure that will make those women more comfortable.
  • You put trans women at real, proveable, risk by putting them in mens bathrooms. Assault and harassment against trans women is common, unlike trans women against women.
  • As mentioned in the post, this is unenforceable. You CAN'T reliably tell if people are trans or not unobtrusively, and you will hurt both cis women and trans women by policing their bodies.

This conservative obsession with people's genitalia is honestly kind of gross. Mind your own fucking business.

The statement "the concept of sex is binary" is scientifically and demonstrably false. These judges did not base their decision on biology, they based it on bigotry. Let's not let the shitty morons reframe the issue as though science is on their side.

I am a fan of those toilets that have a symbol that is half 'male' on the left side half 'female' on the right and are individual rooms that can be used by anyone. Those symbols are essentially defining 'sex' by clothing anyway and making them half and half carries the implication that it doesn't matter where you are on the gender spectrum because both extremes merge into one symbol. They also sidestep the issue of normal people having to share with those nasty bigots. Everyone can shit where they want without consequence and no one needs to be exposed to my farts echoing in the toilet, which for some reason seems to have been designed to amplify the noise of struggle.

There's a trend at some workplaces to force trans people to use the accessible toilets, however those have their own problems.

Not only will you out yourself by using them, but also it takes capacity away from disabled people who already only have one toilet to share between them at times.

That's why I like the individual toilets as standard. The only thing you out yourself as is someone who needs the toilet. Unfortunately though they require more space so they aren't common .

I wasn't sure how big a deal this whole ruling was, but it's going to impact every trans person every time they need to use the bathroom in public. That seems a big enough deal to me.

Also, a number of quotes used the phrase "women are women and men are men." If someone reading this agrees with that statement, please review the chart below. There's a whole lot of ambiguity between the classic XX woman and XY man.

Well... I agree with the phrase only on the principle that it's a tautology. "X is X" is generally going to be true for anything. I don't agree with it to the extent that it means only cis (wo)men are (wo)men.

I'm disgusted by this ruling, and by the gleeful people celebrating it. TERFs are so fucking tragic because they pretend they care about women's rights, whilst pushing for things that make all women less safe. I'm a cis woman, so ostensibly, rulings like this are done to protect me, which is patently false. This ruling makes me feel very nervous for the safety of my community.
